                About the District’s Encroachment Ordinance

  • The ARCSD has rights-of-way, also known as easements or setbacks, along District roads as indicated on the original subdivision map.
  • Appaloosa Road: 30 feet each side of the center of the road.
  • All other roads: 25 feet each side of the center of the road.
  • The Encroachment Ordinance was adopted in 2007.  Prior to its adoption some fences and other objects were installed within the rights-of-way.
  • The Ordinance was adopted to ensure future encroachments and improvements maintain consistency, meet certain construction criteria, and are installed with the District Board’s oversight.
  • Therefore, similar to County requirements, a permit from the District is required for any driveway encroachment access to a parcel, or any intrusion, temporary or permanent into, across or under the District’s right-of-way.  (See Encroachment Permit Application)
  • ·Since adoption of the Ordinance, nothing may be placed within or through these rights-of-way without an approved permit issued by the District.
  • The ordinance was developed with the assistance and approval of Calaveras County Counsel’s office, conforms to the California Streets and Highways Code and has the force of State law.
  • ·Special note on fences: All new fence lines must be installed outside the road rights-of-way. Fences installed inside the rights-of-way will be required to be removed or relocated at the owner’s expense.
